Seniors file Class Action Suit Against Living Trust Sellers

A class action suit has been filed by several Texarkana residents against the salesmen and company they claim tricked them into buying “unnecessary and often useless” living trusts. According to the suit, the sellers invited senior citizens for a free dinner, then gave presentations that “misrepresent” the extent of probate fees and estate taxes in order to convince seniors that they need to purchase a trust in order to protect their estate and heirs.

The suit alleges that the trust sellers are not licensed to practice law, but hire an attorney to “rubber stamp” the proceedings, to preserve the impression of legality. It accuses the defendants of fraud, unauthorized practice of law, negligence, breach of fiduciary duty, and conspiracy.
